1Homemade Food Disclosure
All food products offered for sale by Who’s Your Daddy Coconut Bites (the “Seller”) are homemade food products prepared in a private residential kitchen located in the State of Utah and are sold pursuant to the Utah Home Consumption and Homemade Food Act, Utah Code Title 4, Chapter 5a. NOT FOR RESALE. PROCESSED AND PREPARED WITHOUT THE BENEFIT OF STATE OR LOCAL INSPECTION. The products are not certified, licensed, regulated, or inspected by the State of Utah, the Utah Department of Agriculture and Food, any local health department, or any county or city. The products are not prepared in a commercial or licensed food establishment, and the individuals preparing them do not hold a food handler’s permit.
2Terms of Sale
Products are produced and sold exclusively within the State of Utah, in person, directly to the final consumer at a prearranged location, and solely for personal or home consumption. Products may not be resold, redistributed, or offered for sale by any purchaser or third party. By placing an order, the purchaser affirms that the purchaser is an informed final consumer and has read and understood this disclosure in its entirety.
3Allergen Warning
The Seller’s products contain, or are prepared in a kitchen that handles, the following major food allergens and allergenic ingredients:
- Tree nuts, including almonds, cashews, macadamia nuts, pecans, and hazelnuts
- Peanuts
- Milk and dairy products, including milk chocolate, white chocolate, and cream cheese
- Coconut
All products are prepared in a single home kitchen using shared equipment, utensils, and surfaces. Accordingly, any product, regardless of flavor, may contain or come into contact with any of the foregoing allergens, as well as other allergens, including soy, wheat, and eggs. The Seller does not maintain an allergen-free environment and makes no representation or guarantee that any product is free of any allergen. Persons with food allergies or sensitivities should not consume the Seller’s products.
4Assumption of Risk
The purchaser acknowledges that homemade food prepared without government inspection carries inherent risks, including foodborne illness, allergic reaction, and the presence of undeclared ingredients or foreign material. The purchaser knowingly and voluntarily purchases and consumes the products at the purchaser’s sole risk and expressly assumes all risks associated therewith.
5Disclaimer of Warranties
All products are provided “AS IS” and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.
6Limitation of Liability
To the fullest extent permitted by the laws of the State of Utah, the Seller, its owners, and its agents shall not be liable for any illness, injury, allergic reaction, loss, or damage of any kind arising from or related to the purchase, handling, storage, or consumption of any product.
7Responsibility for Third Parties
A purchaser who serves, gifts, or otherwise provides any product to another person assumes sole responsibility for communicating this disclosure, including the allergen warning, to that person before consumption.
8Governing Law
This disclosure shall be governed by and construed in accordance with the laws of the State of Utah.
